Terms of Service
These terms apply when you use the website daydreamdigital.app and the mobile and web apps provided by Daydream Digital LLC ("we", "us") (the "Services"). By using the Services, you agree to these terms. If you don't agree, please don't use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or guardian.
2. Your account
Some apps let you create an account. You are responsible for keeping your login details safe and for activity under your account. Let us know right away if you think your account has been misused.
3. Your content
You own the content you create or upload ("Your Content"). You give us a limited license to host, store, process, and display Your Content only as needed to run the Services for you, including sharing it when you choose to share it. You are responsible for Your Content and confirm you have the right to use it.
4. Acceptable use
You agree not to:
- Break the law or infringe anyone else's rights
- Upload content that is illegal, hateful, harassing, sexually explicit, or that exploits minors
- Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Services
- Use automated means to access the Services in a way that abuses them
We may remove content or suspend or close accounts that break these rules.
5. AI features
Some features use artificial intelligence to produce results, such as reading a receipt or estimating calories. These results can be wrong. Check them before relying on them. AI-generated results are not professional advice. In particular, nutrition estimates are not medical or dietary advice.
6. Purchases and subscriptions
Paid features bought through the App Store or Google Play are subject to Apple's or Google's terms, including their billing, renewal, cancellation, and refund policies. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your device's subscription settings. Prices and features may change. We will give notice where required.
7. App store terms
If you download an app from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement, and Apple is not responsible for the app or its support. If you download from Google Play, Google Play's terms also apply.
8. Our intellectual property
The Services, including their design, code, and branding, belong to us or our licensors. We give you a personal, non-transferable, revocable license to use the Services under these terms.
9. Changes and termination
We may change, suspend, or discontinue any part of the Services at any time. You may stop using the Services at any time. We may suspend or end your access if you break these terms.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAYDREAM DIGITAL LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places don't allow these limits, so they may not fully apply to you.
12. Indemnity
You agree to defend and indemnify Daydream Digital LLC against claims arising from Your Content or your violation of these terms, to the extent permitted by law.
13. Governing law
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Clark County, Nevada, unless the law where you live requires otherwise.
14. Changes to these terms
We may update these terms. We will change the effective date above and, for significant changes, give notice in the relevant app or on this website. Continuing to use the Services after a change means you accept the updated terms.
